Terms of Service

1. Agreement

By creating an account or using Qualyo Forms (the “Service”), you agree to these terms and the Privacy Policy. If you use the Service for an organization, you represent that you are authorized to accept these terms for that organization. If you do not agree, do not use the Service.

2. What the Service provides

Qualyo is a web-based visual form builder. It supports conversational and classic delivery, deterministic routing, public links and embeds, responses, private file uploads, drawn-signature questions, analytics, CSV export, notifications, and optional AI wording, qualification, and summaries. Paid capabilities include larger monthly AI bundles, custom domains, logo upload, branding removal, and fast AI mode. Webhooks and notification recipients are available on every plan.

Qualyo is not currently advertised as a CRM, payment, contract-generation, managed legal e-signature, healthcare, employment, credit, or legal-decision product. A drawn-signature question is an input field, not a complete document-signing workflow. Third-party destinations such as calendars, CRMs, and automation systems are reached through external ending links or webhooks unless a page explicitly documents a native integration.

3. Accounts and workspaces

You must provide accurate account information, keep credentials secure, and promptly report suspected unauthorized access. You are responsible for activity in your account, workspace members you authorize, forms you publish, notification recipients, domains, webhooks, and the lawfulness of the information you collect.

4. Plans and AI conversations

Static forms and submissions are unlimited on every current plan. Free includes 50 lifetime AI conversations that do not reset. Purchasable Pro bundles include 250, 750, 2,000, or 5,000 AI conversations per calendar month at the prices shown before checkout. One respondent journey counts once after its first successful AI request; later AI turns in that same journey are included. Paid allowances reset monthly, do not roll over, and do not create automatic overage charges.

When an AI allowance is unavailable, the static form remains usable and each Qualifier follows the automatic qualify or disqualify fallback selected by the form owner. Existing eligible subscribers may retain a grandfathered Legacy Pro plan until they cancel or choose a current plan.

5. Prices, billing, and cancellation

Current monthly prices are $29, $49, $79, and $129 USD for the four Pro bundles. Annual prices are $290, $490, $790, and $1,290 USD and are billed once yearly. Stripe processes checkout, renewals, billing details, plan changes, and cancellation status. The amount, currency, interval, and effective timing shown in checkout or the billing portal must be reviewed before confirmation.

You may manage or cancel a paid subscription through the available billing portal. A cancellation scheduled for the end of a billing period is reflected by Stripe and the Service. Qualyo does not publish a blanket refund promise. Contact support about a suspected billing error or refund request; rights required by applicable law are unaffected.

6. Your content and respondent data

You retain your rights in form content and submitted data. You grant Qualyo a limited right to host, store, transmit, display when you publish it, and process that content only as needed to provide, secure, support, and improve the Service and comply with law. You represent that you have the rights, notices, and consents needed for the content and respondent data you collect.

7. Acceptable use

Do not use the Service to break the law; infringe rights; send spam; deceive respondents; distribute malware; probe or bypass access controls; disrupt the Service; overload systems; impersonate others; collect data without a lawful basis; or make prohibited consequential decisions without appropriate notice, review, and safeguards. Do not submit secrets or sensitive data that your workflow does not require.

8. AI features

AI output can be incomplete, biased, unavailable, or incorrect. You choose the qualification instructions, routes, and automatic fallback and remain responsible for reviewing the workflow and its outcomes. Do not use AI output as the sole basis for healthcare, employment, credit, housing, legal, or other consequential decisions. AI features may use configured third-party model providers as described in the Privacy Policy.

9. Third-party services

The Service depends on providers such as Supabase, Vercel, Stripe, AI/model providers, email providers, analytics providers, domain services, and any external endpoint or link you configure. Their products and terms are separate. Qualyo is not responsible for a third-party destination you select or for changes made by that provider.

10. Service changes and availability

We may maintain, secure, change, add, or remove features and may set reasonable technical limits. We aim to keep published plan and product descriptions current, but the Service may be interrupted and no uptime commitment is made unless a separate written agreement says otherwise. Material price or term changes will be presented prospectively as required.

11. Suspension, cancellation, and deletion requests

You may stop using the Service and cancel a paid subscription. You may request account or personal-data deletion through support; identity verification and retention needed for billing, security, dispute, backup, or legal records may apply. We may limit, suspend, or terminate access for nonpayment, security risk, unlawful conduct, material breach, or harm to the Service or others.

12. Disclaimers

To the extent permitted by applicable law, the Service is provided “as is” and “as available.” Qualyo does not promise that every form will convert, that every AI outcome will be correct, that third-party services will remain available, or that the Service will be uninterrupted or error-free. Nothing in these terms excludes a warranty or right that cannot legally be excluded.

13. Limitation of liability

To the extent permitted by applicable law, Qualyo is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from the Service. Any limitation applies only to the extent enforceable in the relevant jurisdiction.

14. Changes and contact

We may update these terms as the Service or legal requirements change. The effective date above will change when the public terms change materially. Questions, billing concerns, and account or deletion requests may be sent to support@qualyoforms.com or through the contact page.
